10. Import and export of sturgeon species and products from them, including caviar

Licensing of the importation into the Russian Federation and exportation from the Russian Federation of this category of goods is carried out in accordance with Decree of the Government of the Russian Federation of August 17, 1998 N 968 (Order of the Ministry of Trade of Russia of November 23, 1998 N 36).

Receipt of applications and registration of licenses for the import and export of this category of goods is carried out exclusively by the Authorized Ministry of Trade of Russia in the Central District in coordination with the Department for State Regulation of Foreign Economic Activity (DRGRED) in the manner outlined in section II, paragraph 1.1 of these Guidelines.

When accepting the application, it is necessary to take into account that the applicant, in addition to the documents specified in Section I, clause 1.1, must submit the original Authorization (s) (s) (certificate (s)) of CITES Sturgeon Authority in Russia.

When issuing licenses for the import and export of goods of this category, approval of an application for a license with the State Committee for Ecology of Russia is not required, except for the cases when licenses are issued for the export from the Russian Federation of live sturgeon fish, developing sturgeon caviar and milt (sperm) - live (TN codes Foreign Economic Activity of the CIS: from 0301 99 190 (only sturgeon), from 0511 91 900 (only sturgeon). In these cases, licenses are issued subject to approval of the application for a license by the Goskomekologiya of Russia in the manner specified in the the approval of licenses for the export of animal and plant resources ", approved by the Order of the former Ministry of Natural Resources of Russia No. 40 of 02/05/96, by filling in the requisite 26 license applications in accordance with the Rules for filling out an application for a license, approved by the Order on MVES of Russia of March 18, 1997 N 144 .

In all cases, applicants for this category of goods are issued only one-time license.

It should be borne in mind that the Permit (certificate) is issued by the CITES Administration Authority for Sturgeon in Russia for a period of six months. In this case, the license validity period may not exceed the validity period of the specified Permit.

It is allowed to issue one license for goods supplied by one or several batches within one contract for several Permits (certificates) issued by the CITES Sturgeon Authority in Russia, provided that the information specified in the license details: 4 - 14, 18, 19 fully coincides with each pariah goods. At the same time, the license validity period is limited to the validity period of the Permits (Certificates) of the CITES Sturgeon Administrative Authority in Russia, but cannot exceed 12 current months from the date of issuance of the license.

The information of the Ministry of Agriculture that Russia increased the export of black caviar three times, turned out to be a lie. In fact, its deliveries abroad and total domestic production have not changed, remaining at the 2014 level. This was reported in Rosrybolovstvo.

But the cost in the domestic market of black caviar, which has always been the hallmark of our country, has increased by 25-30% over the past few months due to the devaluation of the ruble. Now this is a real delicacy - inaccessible to the absolute majority of Russians. When the Ministry of Agriculture, referring to some customs statistics, happily reported that “domestic producers, despite European sanctions, are rebuilding their positions in the export market of black caviar by leaps and bounds”, they all decided: here it is import substitution into action. It was doubly unexpected that the "breakthrough" occurred during the period of the moratorium on sturgeon fishing. Their fishing in Russia is allowed only for scientific purposes and for reproduction.
  Nevertheless, the Ministry of Agriculture claimed that over the past year, the delivery of delicacies abroad increased threefold, compared with the same period of 2014. A total of 4.71 tons of black caviar were exported (against 1.65 tons in the year before last). At the same time, the annual volume of its production in our country is 50 tons.
  At the same time, the import of these products practically by the same volumes decreased to 3.5 tons in January-November 2015 (against 8.67 tons in 2014). The increase in exports in the department was associated with the development of sturgeon aquaculture production and the favorable situation prevailing in foreign markets due to the difference in exchange rates.
  However, the beautiful story about how “Russia began to feed the West with black caviar” turned out to be a fake. According to data provided by the press service of the Federal Agency for Fishery, the export volume of sturgeon caviar in 2015 has not changed since the year before last, reaching about 6.7 tons. The same situation with production: 43 tons as it was in 2014, and remained in 2015.
  Moreover, compared to 2013, the export of sturgeon caviar decreased by 0.6 tons. But its price in the domestic market has increased significantly. For example, a year ago, you could buy sterlet caviar at the Cheryomushkinsky capital market from 40 thousand rubles per 1 kg (sturgeon was even more expensive), but now you won't find black caviar at 60 thousand rubles.
  It’s still not clear why the Ministry of Agriculture needed to “embellish” reality.
On the contrary, Rosrybolovstvo says that one can hardly count on a significant increase in exports, since production volumes are still small. “Within our capabilities, we are trying to support the industry. - stated in the committee. - In 2015, about 100 million rubles were allocated for commodity sturgeon farming. State support is envisaged for the years 2016-2017. In addition, to curb illegal traffic, a draft law has been developed that provides for the maintenance of the register of manufacturing enterprises, as well as marking with a special brand of sturgeon products. This is done by analogy with the existing system of traceability of products in the alcohol industry (EGAIS). Poaching products are often legalized through aquaculture farms, therefore it is necessary to control the relevant enterprises, to know the volumes of their production. Now this document is being coordinated with other departments. ”

Currently, few Russians have tried the most famous Russian delicacy - black caviar, while the import of these foreign products to Russia is many times higher than exports. At the same time, experts are anxiously observing the activity of Chinese "producers" who are ready to flood our market with their goods.

According to estimates by the Federal Customs Service last year, imports of legal caviar from China increased threefold and exceeded 5,500 kilograms. At the same time, the producers register “Russian registration” for Chinese caviar. At present, the Rosselkhoznadzor has certified 126 Chinese companies that can import caviar and sturgeon meat into the territory of the Russian Federation. Unfortunately, many unscrupulous entrepreneurs repackage Chinese caviar in Russian-made banks and sell it as Russian. One possible measure to counter this could be product labeling.

Along with red caviar and sturgeon, it is proposed to chip and black caviar. The idea is correct, but it only partially helps to stop the flow of counterfeit on the shelves. According to industry experts, additional restrictive mechanisms are needed.

The Ministry of Agriculture left this proposal with the government in March. It is assumed that the marking will be applied directly to the jar with the products. At the same time, as explained in Rosrybolovstvo, chip caviar will be somewhat similar to the process of labeling alcohol, which is already underway within the framework of the Unified State Automated Information System (EGAIS). With the help of electronic labeling it will be possible to find out the origin of the goods, trace the logistics and be sure that you have a legal, and not poaching product.

Recall that legal extraction of natural black caviar in Russia is impossible. In 2007, first Russia and then the rest of the Caspian region countries stopped commercial sturgeon fishing. Despite this, the poaching of fish continues.

The import of black caviar from China over the year amounted to about 5.5 tons

Of course, chipping is a necessary and correct initiative that will help fight counterfeiting and counterfeiting, says Tamara Kasyanova, general director of 2K. “In principle, this is the most modern way today,” she believes. “But its implementation should be accompanied by other measures. In particular, it is necessary to fight unscrupulous sellers through spot checks of outlets, as well as restaurants that can directly buy products from underground workshops. " The role of advertising is also important, in which it will explain to consumers exactly how a real bank should look like and how to check whether it is true caviar or not.

However, according to the Sturgeon Union of Russia, chipping can only partially help. Nothing will prevent unscrupulous producers from repacking Chinese caviar in their banks and writing “made in Russia” on them, as was done at the Rzhevsky fish-breeding complex, and putting in any chips and the like. “In our opinion, tighter control by the state could also imply licensing of all participants in this market,” industry players say.

According to experts polled by RG, Chinese products are always cheap products, but cheapness is achieved through loss of quality, and this applies to absolutely everything.

When it comes to foods of animal origin, food is of great importance. Sturgeon is a special fish, it must have fish meal of the highest quality on the menu (this is almost a third of the whole diet). The Chinese in sturgeon feed use both genetically modified components, and add anything to the feed (even feather meal), without worrying about the quality of the final product. Very often, the conditions in which fish are contained there force a considerable amount of drugs and antibiotics to be added to feed - otherwise it simply will not survive. So, saving on everything, they manage to minimize its cost, but this affects the quality.

In addition, it is generally quite difficult to grow environmentally friendly and produce a natural product on Chinese soil: given the enormous scale of industrial development, the ecology was simply forgotten - most importantly quickly and with minimal cost. Today this problem has become simply catastrophic. China today produces 50 percent of all world aquaculture products, and it is precisely because of its low quality and often its content of hazardous substances that it sells on the world market on the cheap. That is why even in China, wealthy people buy only imported products - they do not want to put at risk themselves and their loved ones.

If the Chinese low-grade caviar continues to be issued for high-quality Russian, this will lead to a complete discredit of the world-famous Russian delicacy. And people who have never tasted black caviar or tried it for a long time, will think that this is exactly what it should be.
